Acceptance of Terms

By downloading or using CalorieDay (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the App.

Description of Service

The App provides calorie and nutrition tracking, a food diary, photo-based food recognition, goal calculations, and related features intended to help you understand and track what you eat.

Health & Nutrition Disclaimer

The App is provided for general wellness and educational purposes only and is not medical or dietary advice. Calorie, macronutrient, and goal figures — including those produced by photo recognition or food-database matches — are estimates and may be inaccurate. Do not rely on them for medical, clinical, or therapeutic purposes.

You should consult a qualified healthcare professional before changing your diet or beginning any weight-loss or weight-gain program, especially if you are pregnant, are under 18, have a medical condition, or have a history of disordered eating. Your use of the App is at your own risk.

Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to misuse the App, interfere with its operation, or attempt to access it using unauthorized methods.

Purchases & Subscriptions

The App offers optional paid content. All payments are processed by Apple through your App Store account, and the price is shown in the App before you confirm any purchase.

Subscriptions. A subscription unlocks the App's premium features for as long as it stays active. Subscriptions are offered on weekly and yearly terms and renew automatically at the price and interval shown at the time of purchase, unless canceled at least 24 hours before the end of the current period. Where a free trial is offered, it converts into a paid subscription unless you cancel before the trial ends. You can manage or cancel a subscription at any time in your App Store account settings; cancellation takes effect at the end of the current period.

One-time purchases. Separately from subscriptions, the App may offer individual items that unlock additional paid content or features. These are one-off purchases rather than subscriptions: they do not renew, and you are not billed for them again. A one-time purchase is not included in any subscription, and holding an active subscription does not grant it. Items that unlock permanently stay available to the Apple ID that bought them and can be restored on a new device using Restore Purchases.

Refunds

Refunds for App Store purchases are requested through Apple and are granted or declined by Apple at its sole discretion. We cannot issue, approve, or reverse an App Store refund.

When you request a refund, Apple may ask us for information about how the purchase was used. You agree that we may share that information with Apple so your request can be assessed on your actual usage rather than on guesswork. This covers your account age, how much you have used the App, whether the purchased content or feature was delivered and used, and amounts paid or previously refunded. We report this information as recorded, and share it only with Apple, only in response to your own refund request. See our Privacy Policy for more detail.

Intellectual Property

All content, including text, graphics, nutrition data compilations, and software, is owned by us or our licensors and protected by intellectual property laws. You may not copy, distribute, modify, or reverse engineer the App except as permitted by law.

Privacy

We collect limited usage and diagnostic data to improve the App’s performance and reliability. We also use anonymized behavioral analytics through PostHog session replay where enabled to improve app usability. Session replay is disabled for users in GDPR regions and California, and is not used to identify you personally. For more information, please see our Privacy Policy.

Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the App will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Termination

We may suspend or terminate access to the App at any time without notice if these Terms are violated. You may stop using the App at any time.

Changes to the Terms

We may update these Terms from time to time. Continued use of the App after updates constitutes acceptance of the revised Terms.
